Attorneys Joel Babcock and Matthew Cecil recently secured an appellate victory for their HOA client following a successful bench trial in 2023. Joel and Matt obtained a complete defense verdict at trial where Plaintiffs claimed the HOA failed to manage and even contributed to surface water runoff onto their property and ground water levels beneath it, allegedly resulting in over $100,000 in monetary damages and requesting hundreds of thousands of dollars in additional equitable relief. Plaintiffs appealed several of the trial court’s legal and evidentiary rulings following the defense verdict. The Colorado Court of Appeals rejected each of Plaintiffs’ arguments and affirmed the trial court’s judgment for the HOA.
