Shannon Hughes Obtains Dismissal of Claims

Shannon Hughes obtained a favorable outcome for a national retail client in an alleged assault case. The Plaintiff alleged that while shopping, she urgently needed to use the restroom. Despite the restroom being closed for cleaning (with warning signs and a cleaning cart blocking the entrance), Plaintiff forced her way inside. An employee cleaning the restroom warned her not to enter due to wet floors. Plaintiff pushed past anyway towards the restroom stall and began to use the restroom. After coming out of the restroom, Plaintiff claimed that the employee physically grabbed her and then stood inside the bathroom stall watching Plaintiff.

The Court found Plaintiff’s allegations were unsupported. No witnesses corroborated her claims, the physical layout of the restroom stall made her version of events impossible, and a police investigation concluded there was no probable cause. Agreeing with these findings, the Court dismissed all of Plaintiff’s claims with prejudice.
