Court of Appeals Affirms Directed Verdict in Premises Liability Case
The Court of Appeals affirmed the directed verdict. In reaching its decision, the Court of Appeals found “the evidence raise[d] only the possibility of the occurrence of an event, the jury would have no real evidentiary foundation for determining that the event occurred.”
Colorado House Bill 20-1290 Failure to Cooperate and the Colorado Supreme Court Decision to Allow the General Session to Continue Beyond 120 Consecutive Days
The House of Representatives of the Colorado General Assembly introduced HB 20-1290 regarding the failure to cooperate defense in February 2020. The bill addresses the ability of an insurer to use a failure to cooperate defense in an action in which the insured has made a claim for benefits under an insurance policy. After suspension of the General Session due to the pandemic, the fate of the bill remains uncertain.
